Legally binding terms for using NOLA Car Rental PRO services.

These Terms of Service (the “Terms”) govern your access to and use of the websites, mobile applications, reservation systems, and vehicle rental services (collectively, the “Services”) provided by NOLA Car Rental PRO (“NOLA Car Rental PRO”, “we”, “us”, or “our”). By creating an account, making a reservation, signing a rental agreement, or otherwise using our Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Services or rent a vehicle from NOLA Car Rental PRO.

1. Eligibility and Driver Requirements

To rent or operate a vehicle from NOLA Car Rental PRO, you must meet all eligibility and driver requirements set out in these Terms and any rental agreement you sign at the time of pickup. At a minimum, you represent and warrant that:

  • You are at least 21 years old (a higher minimum age may apply to certain vehicle classes).
  • You hold a valid, current driver’s license for the class of vehicle rented, issued by the jurisdiction of your residence.
  • You are legally permitted to drive in the State of Louisiana and any other jurisdiction in which the vehicle will be operated.
  • You have a major credit card or other approved payment method in your own name.
  • You have not provided us with any false, misleading, or incomplete information.

Additional drivers must be approved by NOLA Car Rental PRO, meet all eligibility requirements, and may be subject to additional fees. You are responsible for ensuring that any authorized driver complies with these Terms.

2. Reservations, Pick-Up, and Return

Reservations made through our website, mobile app, or by phone are offers to rent a vehicle subject to availability and confirmation by NOLA Car Rental PRO. We reserve the right to decline or cancel reservations at our discretion, including if eligibility requirements are not met or payment authorization is unsuccessful.

  • Pick-up: You must present a valid driver’s license and payment method at pick-up. The name on the payment method must match the primary driver’s name.
  • Return: Vehicles must be returned to the designated location, on or before the return date and time specified on your rental agreement.
  • Late returns: Late returns may result in additional hourly or daily charges, as specified in your rental agreement, plus any applicable fees.
  • Early returns: Early returns typically do not result in a refund of unused time unless required by applicable law or expressly stated in your rental agreement.

3. Rates, Fees, and Payment

You agree to pay all charges and fees associated with your rental, including base rates, mileage (if applicable), optional services, taxes, surcharges, tolls, fines, and any other amounts described in your rental agreement or these Terms.

  • Authorization hold: At pick-up, we may place a temporary authorization hold on your payment method to cover estimated charges and a security deposit.
  • Final charges: Final charges will be calculated at the end of the rental based on actual usage, fuel level, late fees, damage assessments, and any additional services selected.
  • Additional fees: You may be charged additional fees for cleaning, smoking in the vehicle, loss of keys, administrative fees related to citations, toll processing fees, and other items described in your rental agreement.
  • Currency: Unless otherwise specified, all charges are in U.S. dollars (USD).

4. Use of the Vehicle

You agree to operate the vehicle in a safe, lawful, and responsible manner. You are responsible for the vehicle from the time you take possession until the vehicle is formally checked in by NOLA Car Rental PRO.

Prohibited uses include, but are not limited to:

  • Using the vehicle for any illegal purpose or in connection with any criminal activity.
  • Operating the vehicle under the influence of alcohol, drugs, or any other substance that may impair driving ability.
  • Allowing an unauthorized driver to operate the vehicle.
  • Using the vehicle to push or tow another vehicle or object, unless expressly authorized in writing.
  • Using the vehicle for ridesharing, delivery services, or other commercial purposes without our prior written consent.
  • Operating the vehicle in off-road conditions or on unpaved roads not reasonably suited for passenger vehicles.
  • Smoking or vaping inside the vehicle.
  • Transporting hazardous materials in violation of applicable law.

You are responsible for any damage, loss, or liability resulting from prohibited uses or violations of these Terms or applicable law.

5. Fuel, Mileage, and Maintenance

  • Fuel: Unless otherwise specified, vehicles are provided with a certain fuel level and must be returned with the same level. If fuel is missing, you may be charged a refueling fee at the rate specified in your rental agreement.
  • Mileage: Your rental may include unlimited mileage or a mileage limit. Excess mileage charges may apply if you exceed the included mileage.
  • Maintenance: You must promptly notify NOLA Car Rental PRO of any mechanical issues, warning lights, or damage. You must not authorize any repairs without our prior consent, except in emergencies where immediate action is required for safety.

6. Insurance, Protection, and Liability

NOLA Car Rental PRO may offer optional protection products, such as collision damage waivers or supplemental liability coverage, subject to the terms and exclusions of each product. The availability and details of such products will be disclosed to you at the time of rental.

Your personal auto insurance or credit card benefits may provide coverage for rental vehicles. It is your responsibility to review your policies and determine the coverage that applies. Declining optional protection products may result in you being fully responsible for all loss or damage to the vehicle, up to the full replacement value, plus related fees and diminished value, as permitted by law.

7. Damage, Accidents, and Theft

You must immediately notify NOLA Car Rental PRO and local law enforcement in the event of an accident, theft, vandalism, or any other incident involving the vehicle. You must cooperate fully with any investigation, provide accurate and complete information, and complete any required incident or damage reports.

Except where prohibited by law or limited by any protection product you have purchased, you are financially responsible for all physical damage to, or loss of, the vehicle, as well as towing, storage, loss-of-use charges, administrative fees, and any associated costs.

8. Traffic Violations, Tolls, and Fines

You are responsible for all traffic, parking, and toll violations, as well as any fines, penalties, or administrative fees imposed in connection with your use of the vehicle. Where permitted by law, NOLA Car Rental PRO may pay such amounts on your behalf and charge your payment method, plus a reasonable administrative fee for processing each violation or toll notice.

9. Cancellations, No-Shows, and Modifications

Our cancellation and modification policies may vary by rate, location, and channel of booking and will be presented to you at the time of reservation. Certain prepaid or promotional bookings may be non-refundable or subject to specific change or cancellation fees.

If you fail to pick up your reserved vehicle at the scheduled time without prior cancellation, you may be charged a no-show fee or forfeit any prepaid amount, as permitted by law and stated in your reservation details.

10. Accounts, Security, and Communications

To use certain features of the Services, you may be required to create an account with NOLA Car Rental PRO. You agree to provide accurate, current, and complete information and to keep your login credentials confidential. You are responsible for all activity that occurs under your account.

By using the Services, you consent to receive transactional communications from NOLA Car Rental PRO, including emails, text messages, and in-app notifications related to your reservations, rentals, and account activity. Marketing communications are subject to your consent preferences and our Privacy Policy.

11. Intellectual Property and Website Use

All content, trademarks, logos, and other intellectual property appearing on the NOLA Car Rental PRO websites and apps are owned by or licensed to NOLA Car Rental PRO and are protected by applicable intellectual property laws. You may use the Services only for personal, non-commercial purposes in connection with renting vehicles from us.

You must not copy, modify, distribute, scrape, reverse engineer, or otherwise misuse the Services or any content appearing on them, except as expressly permitted by these Terms or applicable law.

12. Privacy

Our collection, use, and sharing of personal information in connection with the Services are described in the NOLA Car Rental PRO Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you acknowledge that you have reviewed our Privacy Policy and consent to our data practices as described therein.

13. Disclaimers and Limitation of Liability

Disclaimers. To the maximum extent permitted by law, the Services and vehicles are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the availability of any specific vehicle, feature, or rate, nor the uninterrupted or error-free operation of our websites or apps.

Limitation of liability. To the fullest extent permitted by law, NOLA Car Rental PRO and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits or revenues, arising out of or in connection with your use of the Services or any rental, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to these Terms or any rental will not exceed the total amount paid by you for the rental giving rise to the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless NOLA Car Rental PRO and its affiliates, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services or any vehicle; (b) your breach of these Terms or any rental agreement; or (c) your violation of any law or the rights of any third party.

15. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to the Services or any rental will be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict-of-laws principles. The exclusive venue for any legal action arising out of or related to these Terms will be the state or federal courts located in Orleans Parish, Louisiana, and you consent to the personal jurisdiction of such courts.

16. Changes to These Terms

NOLA Car Rental PRO may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, provide additional notice. Your continued use of the Services after any changes become effective constitutes your acceptance of the revised Terms.

17. Miscellaneous

  • Entire agreement: These Terms, together with your rental agreement and our Privacy Policy, constitute the entire agreement between you and NOLA Car Rental PRO regarding the subject matter herein.
  • Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • No waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
  • Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms at any time without notice.
